[摘　要]当前，我国已发布若干意见明确了国土空间体系建立的制度框架，在国土空间规划体系条件下，城市规划行政许可的规制对象已经扩展为建设活动与土地使用。文章提出在国土空间规划体系下城市规划行政许可制度的建立应当基于《中华人民共和国行政许可法》的理念与原则，继续对当前《中华人民共和国城乡规划法》《中华人民共和国土地管理法》中的行政许可事项、流程进行改革与整合；规划许可可以采用包括4个过程的“一书两证”的许可制度，但应通过精简审批事项、统一技术标准、完善运行机制，提升在社会主义市场经济制度下城市规划行政许可在空间发展与土地使用中的治理能力。

The Institutional Transition of Urban Planning Permission in Territorial Spatial Planning System/

[Abstract]  Chinese central government has issued opinions on the institutional framework of the territorial spatial planning system.Within the framework urban planning permission regulation has expanded to both construction projects and land uses. The permission items and processes in the two systems, Urban and Rural planning Act and Land Management Act, shall be further reformed and integrated according to the principles of Administrative Permission Act. The new planning permission system may continue to adopt the 4 processes and “1 note and 2 certificates”, but should simplify permission items, unify technical standards,and improve working mechanism, so that the governance capacity of the new urban planning permission on spatial development and land use may be improved in the socialist market economy.

    最近，我国发布了《中共中央 国务院关于建立国土空间规划体系并监督实施的若干意见》(以下简称《意见》)，将主体功能区规划、土地利用规划、城乡规划等空间规划融合为统一的国土空间规划体系。这标志着国土空间规划体系制度框架的确立，也预示着地方政府规划许可制度的转型。国土空间规划体系不仅规制《中华人民共和国城乡规划法》(以下简称《城乡规划法》)中的建设活动，又规制《中华人民共和国土地管理法》(以下简称《土地管理法》)中的土地使用。虽然国土空间规划是全域的空间管制制度，但是发展矛盾最集中、最突出的依然是在城市或城镇。在《国土空间规划法》尚未出台前，我国建设项目的行政许可仍采用“双轨制”。因此，如何按照《意见》提出的“在城镇开发边界内的建设，实施‘详细规划 + 规划许可’的管制方式”及“因地制宜制定用途管制制度，为地方管理和创新活动留有空间”的要求，尽快理清现行城市规划行政许可制度存在的问题，建立国土空间规划体系下的城市规划行政许可制度，是当下迫切需要开展的工作。本文基于《中华人民共和国行政许可法》(以下简称《行政许可法》)，结合《城乡规划法》《土地管理法》，从法律的视野分析城镇增长边界内规划行政许可制度的现实与问题，探讨
