区域与城市治理立法的实践与思考

【摘　要】文章从依法治理区域和城市的迫切性出发，以推进京津冀协同发展的国家战略为契机，在区域层面加快建立立法协同机制，充分发挥“机构—立法—规划”三种手段的作用，同时探索向国家立法机关申请特殊授权以突破制度瓶颈的方式，发挥立法对区域协同的引领和保障作用，为我国其他地区区域协同发展模式创新提供示范。在城市治理中，抓住《立法法》修订的契机，根据城市自身特色和治理需求，积极推进地方立法，同时加快研究与城市公共资源保障、空间管控紧密相关的立法，强化规划的公共政策属性，促进空间规划蓝图落地，保障社会公共利益和产权者的合法利益。

The Practice And Reflection On Legislation In Regional And Urban Governance/Zhang Juan
[Abstract] The paper analyzes the urgency and significance of legislation in regional and urban governance. As the government promotes Beijing-Tianjin-Hebei integrate development, the paper studies the legislative coordination, functioning of  “administration-legislation-planning” measures, and special authorization from national legislature to beak institutional restrictions of the region. The mechanism of legislation as guidance and ensurance in regional development sets a model for other regions. The enaction of Legislative Law provides an opportunity to promote local legislation for public resource and benefits protection, and better spatial governance: enhancement of planning as a public policy, and implementation of spatial blueprints.
