控规修改的市场公平及公众利益影响—对昆明市控规修改的数据分析

【摘　要】随着《中华人民共和国城乡规划法》的实施，全国各地出现了很多控规“编而不批、报而不审”的现象，且控规修改情况越发频繁。在此背景下，文章以昆明市的控规修改为例，对控规修改的结果进行了数据分析，其分析采用“统计+实证”的方式，基于地块和片区两个层面展开；从开发强度、土地利用和建筑形态等方面探究控规修改后的结果，并指出控规修改对于规划落实、市场公平和公众利益的影响。

[Abstract] With the implementing of “The Urban and Rural Planning Law”, there appear a lot of situation like “formation but no ratify” or “report but no examine”, and revise the regulatory plan frequently. Under this background, the paper takes Kunming’s regulatory plan revision as an example, analyzes the data about the result of revision. The analyzing uses statistics and empirical methods, start from plot and district. Then, the paper researches the result from intensity, land utilization, and architectural form way, points out the influence about regulatory plan revision to planning implementation, market equity, and public advantage.

      2008年《中华人民共和国城乡规划法》实施后，全国各地出现了很多控规“编而不批、报而不审”的现象，且控规修改情况越发频繁，控规修改的形式也表现多样，尤其在土地出让前对未批复的“控规草案”或规划条件进行修改的现象比较多。本文将以昆明市的控规修改个案为例展开研究，分析控规修改的具体指标和内容，对控规修改导致的社会问题进行总结。
