《村庄规划用地分类指南》解读

【摘　要】中央一号文件连续十二年聚焦“三农”，说明农村依然是我国发展的重中之重。但是，从2007年《村镇规划标准》(GB 50188—93)废止至今，村庄用地分类缺乏统一指导标准；2013年通过的《中共中央关于全面深化改革若干重大问题的决定》提出，允许农村集体经营性建设用地与国有土地同等入市、同权同价。但是，集体经营性建设用地尚无准确界定。为落实国家宏观政策，填补村庄用地分类空白，指导村庄规划编制、用地管理和用地统计，住房和城乡建设部于2014年4月正式启动《村庄规划用地分类指南》的编制工作，成果于2014年7月11日印发。本文对《村庄规划用地分类指南》的编制背景及前期研究进行阐述，同时对主要创新点及重点、难点问题进行剖析，旨在对《村庄规划用地分类指南》的使用者有所帮助。

Reading Village Planning Land Categorization Guideline/Wang Su, Zheng Xiaorong, Liu He, Zhou Xi, Chu Tianjiao
[Abstract] For 12 consecutive years the first document of the national central government has been on agriculture, countryside, and farmers. Yet village land categorization has lacked a unified standard since the abolition of town and village planning standards in 2007. In 2013 the central government allowed collective commercial land into market for trade like national land. But there is no clear definition of the collective commercial land. The housing and construction bureau promulgates the new village planning land categorization guideline in 2014. The paper studies the background, researches, and analyzes the innovation, emphasis, critical points of the guideline. It is a helpful guidance for the application of the guideline.

      在2007年《镇规划标准》(GB　50188—2007)颁布的同时，1993年颁布的《村镇规划标准》(GB　50188-93)宣布废止。2011年颁布的《城市用地分类与规划建设用地标准》(GB　50137—2011)，对村庄用地分类仅涉及到大类，并未细分，导致了长期以来村庄规划标准缺失，用地分类无据可依，以及村庄规划编制、用地管理、用地统计缺乏统一规范的指导。此外，还导致国家顶层设计难以落实，如2014年中央一号文件提出引导和规范农村集体经营性建设用地有序入市，但何为农村集体经营性建设用地尚无明确界定。
